The New York Legislature ensured guaranteed medical benefits, but no other recourse if you suffered only minor injuries. You can only pursue damages if you are seriously injured.

The New York State Legislature now defines serious injuries as the loss of use of a body part or organ. That excludes fractures or other injuries requiring surgery. If that did not occur, limitation of normal activities for 90 out of 180 days allows the injured party to pursue litigation. The attempt by our legislature to limit frivolous lawsuits now limits our clients' ability to collect damages from a negligent driver.
